Please read these Terms and Conditions carefully before using our website or enrolling in any program offered by Motihari Institute of Digital Marketing (MIDM). 

By accessing our website or submitting an enrollment or inquiry form, you confirm that you have read, understood, and agreed to be bound by these terms. If you do not agree to any part of these terms, please do not use our website or services.

1. Definitions

The following terms are used throughout this document:​

  • “MIDM,” “We,” “Us,” or “Our” refers to Motihari Institute of Digital Marketing, registered under Udyam Registration No. UDYAM-BR-11-0098142, located at Chandmari, Motihari, Purbi Champaran, Bihar – 845401.​
  • “Website” refers to MIDM’s official website and all its pages and content.
  • “User,” “You,” or “Your” refers to any individual who visits the website, submits an inquiry, or enrolls in any MIDM program.
  • “Student” refers to any individual who has formally enrolled in and paid for an MIDM course or program.
  • “Course” or “Program” refers to any digital marketing training module, batch, or curriculum offered by MIDM.
  • “Content” refers to all text, images, videos, study material, course modules, graphics, and other resources published on our website or shared during training.
  • “Fees” refers to the course fee, registration fee, or any other payment associated with enrollment at MIDM.
  • “Guardian” refers to a parent or legal guardian acting on behalf of a minor student between the ages of 16 and 18.

2. Eligibility

To enroll in any MIDM program, you must meet the following conditions:​

  • You must be at least 16 years of age.
  • You must have completed your Class 10 (Matriculation) or hold an equivalent qualification.
  • You must provide accurate and complete information during the enrollment process.
  • You must be legally capable of entering into a binding agreement under the Indian Contract Act, 1872.

MIDM reserves the right to deny enrollment to any individual without obligation to provide a reason, if the eligibility conditions above are not met or if we have reason to believe the information provided is false or misleading.

For Students Between 16 and 18 Years of Age: If you are between the ages of 16 and 18, your enrollment must be completed with the active consent of a parent or legal guardian. 

The parent or guardian must sign the enrollment form on your behalf and will be considered the contracting party for all legal purposes under these Terms and Conditions. By signing the enrollment form, the parent or guardian accepts all terms outlined in this document.​

3. Enrollment and Registration

Enrollment in an MIDM program is confirmed only after all three of the following steps are completed:

  1. Submission of the complete enrollment form with accurate personal and academic details
  2. Payment of the applicable course fee in full, or as per the installment plan agreed upon in writing at the time of enrollment
  3. Receipt of a written confirmation via email or WhatsApp from MIDM

Mere payment of fees does not guarantee enrollment if seats are full or if the student does not meet eligibility criteria. MIDM will communicate seat availability at the time of inquiry. A payment receipt will be provided for every transaction.

4. Fee, Payment, and Refund Policy

Fee Payment and Transparency

All fees applicable to your chosen program, including course fees, registration fees (if any), and applicable taxes, will be communicated to you in full writing before any payment is collected. No additional or hidden charges will be levied after enrollment confirmation.​

Fees can be paid via UPI, bank transfer, cash, or any other payment mode accepted by MIDM at the time of enrollment.

Refund Policy

MIDM follows a fair refund policy in alignment with the Consumer Protection Act, 2019.

  • Registration fees, if charged separately, are non-refundable in all cases.
  • Refunds, where applicable, will be processed within 15 working days to the original payment method.
  • In the case of an installment plan, refund calculations apply only to the amount paid up to the date of withdrawal.

5. Course Structure and Delivery

  • MIDM may deliver courses in classroom (onsite), online, or hybrid formats, as communicated at the time of enrollment.
  • For any changes to course schedules, timings, or batch assignments, MIDM will provide a minimum of 3 days’ written notice to enrolled students.​
  • The course syllabus and learning materials may be updated periodically to reflect the latest industry practices. The updated version replaces any previously communicated curriculum.
  • MIDM does not guarantee that all advertised topics will be covered in every batch, as pace may vary based on student progress and batch requirements.
  • All courses are conducted primarily in Hindi and English. Students must have a working understanding of at least one of these languages to benefit from the program.

6. Student Conduct and Code of Behavior

All students enrolled at MIDM are expected to maintain a respectful and professional environment. The following conduct is strictly prohibited:

  • Disrespecting faculty, staff, or fellow students in any form, whether in person, online, or on social media
  • Sharing, distributing, or reselling MIDM’s course materials, recorded sessions, or study content without prior written permission
  • Using course knowledge or tools provided during training for any illegal or unethical activity
  • Impersonating MIDM, its faculty, or any staff member in any public or private communication
  • Providing false information during or after enrollment

MIDM reserves the right to suspend or permanently remove any student from a program for misconduct, without a refund, at the sole discretion of management.

7. Intellectual Property

All content on MIDM’s website and within its course materials, including but not limited to text, graphics, videos, recorded sessions, study modules, worksheets, logo, and brand identity, is the intellectual property of Motihari Institute of Digital Marketing.​

  • You may not copy, reproduce, distribute, publish, or commercially exploit any MIDM content without prior written permission.
  • Students are granted a limited, non-transferable license to use course materials strictly for their own personal learning during the course duration.
  • MIDM’s logo, name, and brand identity may not be used in any personal, professional, or commercial context without written approval.​
  • Any feedback, suggestions, or ideas submitted to MIDM by students or visitors may be used by MIDM freely, without any obligation of compensation or credit.

8. Certifications and Assessments

  • Students who successfully complete a course and meet the minimum requirements will receive an MIDM Course Completion Certificate.
  • Certification is conditional on a minimum of 75% attendance, submission of assigned tasks, and completion of any final assessments.
  • MIDM certificates are issued by the institute for skill recognition purposes only. They do not constitute a degree, diploma, or qualification recognized by UGC, AICTE, or any government body, unless explicitly stated otherwise.​
  • MIDM reserves the right to withhold a certificate in cases of outstanding fee dues, misconduct, or incomplete course requirements.
  • Certificates will not be issued for partial course completions.

9. Placement Assistance

MIDM provides placement assistance and career support to students who complete their program. The following terms apply:​

  • Placement assistance includes resume building, interview preparation, and sharing of relevant job opportunities through MIDM’s network.
  • MIDM does not guarantee placement or a specific salary package to any student. Career outcomes depend on individual skill, effort, market conditions, and employer decisions.
  • Any salary figures, income ranges, or success stories shared on MIDM’s website, social media, or printed materials are for illustrative purposes only. They represent individual outcomes and are not a promise or guarantee of similar results for any other student.​
  • MIDM is not liable for any financial loss, opportunity cost, or career outcome that a student attributes to the quality or content of our programs.
  • Students are fully responsible for their own job search, interview performance, and professional conduct with prospective employers.

10. Website Use and Acceptable Conduct

By accessing MIDM’s website, you agree that you will:

  • Use the website only for lawful purposes related to learning about MIDM’s programs
  • Not attempt to hack, damage, or disrupt the website or its underlying systems
  • Not submit false, misleading, or spam information through any website form
  • Not scrape, copy, or reproduce website content for commercial use
  • Not attempt to impersonate MIDM or its team through the website or any other platform

MIDM reserves the right to block or restrict access to the website for any user who violates these terms, without prior notice.

11. Disclaimers and Warranties

MIDM provides its website and services on an “as is” and “as available” basis. To the fullest extent permitted by applicable Indian law:​

  • We do not warrant that our website will always be available, error-free, or free of viruses or malicious code.
  • We do not guarantee that course content will meet every individual’s specific career goals or learning expectations.
  • Any third-party links, tools, or platforms referenced in our courses are for informational purposes only. MIDM is not responsible for the content, services, or practices of third-party platforms.
  • MIDM does not make any warranty, express or implied, regarding the fitness of its courses for any particular purpose.

12. Limitation of Liability

To the extent permitted by Indian law, MIDM and its founders, faculty, or staff will not be liable for:​

  • Any indirect, incidental, or consequential loss arising from your use of our website or courses
  • Any loss of income, employment, or career opportunity connected to course outcomes
  • Any technical failure, data loss, or disruption of service on our website or platforms used during training
  • Any errors or inaccuracies in course content that are corrected in later versions

MIDM’s total liability in any claim connected to its services will not exceed the total fees paid by the student for the specific course in question.

13. Privacy

Your use of MIDM’s website and services is also governed by our [Privacy Policy], which is incorporated into these Terms and Conditions by reference. By agreeing to these Terms, you also acknowledge and accept our Privacy Policy.

14. Force Majeure

MIDM will not be held liable for any delay, disruption, or failure to deliver services due to circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, floods, government-imposed restrictions, power outages, internet service failures, health emergencies, or civil unrest.​

In such situations, MIDM will make every reasonable effort to reschedule or deliver the affected sessions at the earliest possible opportunity. If a course cannot be completed or rescheduled within 60 days of the disruption, affected students will be offered a proportionate refund or credit toward a future batch, at the student’s choice.

15. Amendments to These Terms

MIDM reserves the right to update or modify these Terms and Conditions at any time.​

  • All changes will be posted on this page with an updated “Last Updated” date at the top.
  • Continued use of our website or enrollment in our programs after any changes are posted means you accept the revised terms.
  • We recommend checking this page before enrolling in any new course or program.

16. Termination

MIDM reserves the right to terminate or suspend access to its services for any user or student who:​

  • Violates any of these Terms and Conditions
  • Engages in fraudulent, abusive, or illegal behavior
  • Provides false information during or after enrollment

Upon termination, the student’s access to course materials, recorded sessions, and any student portal will be revoked immediately. No refund will be issued in cases of termination due to misconduct or policy violation.

17. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023.

  • Any disputes arising from these terms will first be addressed through direct communication and mutual agreement within 30 days.
  • If a resolution is not reached, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator mutually agreed upon by both parties.
  • The courts of Purbi Champaran, Bihar, India will have exclusive jurisdiction over any legal proceedings related to these terms.
